利用規約 / Terms of Use

本規約は、app-happy.jp（以下「運営者」）が提供するアプリケーション「SHIRO」（以下「本アプリ」）の利用条件を定めるものです。本アプリをダウンロードまたは利用した時点で、本規約に同意したものとみなします。
These terms govern your use of the "SHIRO" application (the "App") provided by app-happy.jp (the "Operator"). By downloading or using the App you agree to these terms.
第1条（サービス内容）
本アプリは、日本の名城を題材としたアートワークを、時間帯・天気・季節に連動した演出とともに鑑賞できるアプリです。一部のコンテンツは無料で、その他のコンテンツは有料プラン「SHIRO PRO」でご利用いただけます。
The App lets you enjoy artwork of famous Japanese castles with time-of-day, weather and seasonal effects. Some content is free; the rest requires the paid "SHIRO PRO" plan.
第2条（有料プラン・お支払い）
- SHIRO PRO には月額プラン、年額プラン（自動更新サブスクリプション）、および買い切りプランがあります。価格は購入画面に表示されます。
- サブスクリプションは、期間終了の24時間前までに解約されない限り、同一期間・同一価格で自動更新されます。
- お支払いは購入確定時に、ご利用の Apple ID に請求されます。
- 購入の管理・解約は、端末の設定（設定 > Apple ID > サブスクリプション）からいつでも行えます。解約後も、支払い済み期間の終了までは引き続きご利用いただけます。
- 機種変更等の際は、アプリ内の「購入を復元」から購入内容を復元できます。
SHIRO PRO offers monthly/yearly auto-renewing subscriptions and a lifetime one-time purchase. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Payment is charged to your Apple ID. Manage or cancel in your device settings. Use "Restore Purchases" on a new device.
第3条(動作環境・機種差異に関する免責)
本アプリの動作は、ご利用の機種・OSバージョン・端末設定・通信環境等により異なる場合があります。これらの環境に起因して、表示・演出・動作が本ページやストア掲載物と異なる場合、または一部もしくは全部の機能（ホーム画面ウィジェット、位置情報に連動した天気表示、天気・時刻演出等を含みますがこれらに限りません）がご利用いただけない場合があります。
運営者は、特定の機種・環境における動作を保証するものではなく、機種・環境による動作の差異、または特定の環境で本アプリの一部もしくは全部が利用できないことを理由とした返金・補償・損害賠償の義務を負いません。
The App's behavior may vary depending on your device model, OS version, settings and network environment. Some or all features (including but not limited to home-screen widgets, location-based weather, and time/weather effects) may be unavailable in certain environments. The Operator does not guarantee operation on any specific device or environment, and shall have no obligation to refund, compensate, or pay damages on the grounds that the App behaves differently or is partly or wholly unusable on a particular device or environment.
第4条（返金について）
- 本アプリの課金は Apple の App Store を通じて処理され、決済・返金は Apple のポリシーおよび手続きに従います。運営者は決済情報を保有しておらず、運営者が直接返金を行うことはできません。
- 返金をご希望の場合は、Apple の「問題を報告する」ページからAppleへ直接申請してください。返金の可否は Apple の判断によります。
- サブスクリプションの解約時に、既に支払い済みの期間に対する日割り・月割り等の返金は行われません。
- 前条に定める機種・環境に起因する事由による返金義務を運営者は負いません。
All purchases are processed by Apple; refunds are governed by Apple's policies and are requested via Apple's "Report a Problem" page. The Operator cannot issue refunds directly. No pro-rated refunds are made for already-paid subscription periods. The Operator has no refund obligation for the device/environment-related grounds described in Article 3.
第5条（免責事項）
- 本アプリは「現状有姿（AS IS）」で提供されます。運営者は、本アプリの完全性・正確性・有用性・特定目的への適合性・継続性について、明示または黙示を問わずいかなる保証も行いません。
- 天気情報は第三者サービス（Open-Meteo）の提供によるものであり、その正確性・最新性を保証しません。天気情報に基づく判断・行動により生じた損害について、運営者は責任を負いません。
- 本アプリのアートワークは鑑賞目的の創作表現であり、実在する城郭の現況・構造・歴史的事実を正確に再現するものではありません。
- 運営者は、事前の通知なく本アプリの内容の変更・追加・提供の中断・終了を行うことができ、これによりユーザーに生じた損害について責任を負いません。
- 通信料等、本アプリの利用に要する費用はユーザーの負担となります。
- 運営者がユーザーに対して損害賠償責任を負う場合であっても、その賠償額は、当該ユーザーが直近12か月間に本アプリに関して運営者（Apple経由を含む）に支払った金額を上限とします。ただし、運営者の故意または重過失による場合、および法令上免責が認められない場合はこの限りではありません。
The App is provided "AS IS" without warranties of any kind. Weather data comes from a third party (Open-Meteo) and its accuracy is not guaranteed. The artwork is a creative representation and does not accurately reproduce the actual castles. The Operator may modify, suspend or terminate the App without notice. To the extent permitted by law, the Operator's total liability is limited to the amount you paid for the App in the preceding 12 months.
第6条（知的財産権）
本アプリに含まれるアートワーク、デザイン、テキストその他一切のコンテンツに関する権利は、運営者または正当な権利者に帰属します。私的利用の範囲を超える複製・転載・再配布・改変を禁じます。
All content in the App belongs to the Operator or its rightful owners. Reproduction or redistribution beyond personal use is prohibited.
第7条（禁止事項）
- 本アプリのリバースエンジニアリング、逆コンパイル、逆アセンブル
- 本アプリの運営を妨害する行為
- 法令または公序良俗に違反する行為
第8条（規約の変更）
運営者は、必要に応じて本規約を変更することができます。変更後の規約は、本ページに掲載した時点で効力を生じます。重要な変更がある場合は、アプリ内または本サイトにて告知します。
第9条（準拠法・裁判管轄）
本規約は日本法に準拠し、本アプリまたは本規約に関して紛争が生じた場合、運営者の所在地を管轄する裁判所を第一審の専属的合意管轄裁判所とします。
